1. Scope of Services

Awcuvix provides professional consultation, integration (setup), and educational training services. These services are designed to support independence through Environmental Control Units (ECU)Electronic Aids to Daily Living (EADL), and Assistive Technology (AT).

  • Awcuvix is a service provider only.
  • Awcuvix does not sell, lease, or manufacture hardware or software products.

2. Hardware and Third-Party Products

All physical devices (including but not limited to tablets, smart hubs, cameras, and sensors) are purchased by the Client or via the Client’s CFSS Goods and Services budget.

  • No Warranty: Awcuvix makes no warranties, express or implied, regarding the performance or longevity of third-party hardware.
  • Manufacturer Support: Any defects, malfunctions, or warranty claims are the sole responsibility of the product manufacturer (e.g., Apple, Amazon, Google).
  • Ownership: All hardware remains the property of the Client.

3. Digital Identity: Passwords and Account Management

To integrate technology, Awcuvix may assist in the creation or management of digital accounts (e.g., Amazon Alexa, Ring, MyChart).

  • Authorization: Awcuvix will only access or manage accounts with the express written or verbal authorization of the Client, Guardian, or authorized Representative.
  • Privacy & Security: Awcuvix does not “own” or permanently store Client passwords. We strongly recommend that Clients change passwords after initial setup is complete.
  • Guest Access: Whenever possible, Awcuvix will utilize “Guest” or “Shared” access features to perform setup without requiring primary account credentials.
  • Liability: Awcuvix is not responsible for any unauthorized third-party access to Client accounts (hacking, phishing) or for data breaches occurring on third-party platforms.

4. Infrastructure Requirements

The Client acknowledges that the effectiveness of the integrated technology depends on external factors, including:

  • Internet/Wi-Fi: A stable, high-speed internet connection provided by a third-party ISP.
  • Power: Consistent electrical power to the home.
  • Third-Party Apps: The continued availability and updates of third-party applications.
    Awcuvix is not liable for system failures caused by internet outages, power surges, or software updates from third-party developers.

5. Not a Life-Safety System

Critical Notice: The technology integrated by Awcuvix is intended to enhance independence and convenience. It is NOT a replacement for professional medical monitoring, emergency services (911), or life-safety fire/burglar alarms.

  • Clients should never rely solely on a smart-home device (such as a voice assistant) as their only means of calling for help in a medical emergency.

6. CFSS Compliance and Training

When providing Worker Training and Development, Awcuvix provides education based on the current standards of the Minnesota Department of Human Services (DHS).

  • Implementation: Awcuvix is responsible for the quality of the training provided. The Client (or their Support Worker) is responsible for the daily implementation and execution of those skills in the home.

7. Limitation of Liability

To the maximum extent permitted by Minnesota law, the total liability of Awcuvix for any claim arising out of our services shall be limited to the total amount paid by the Client (or the FMS on behalf of the Client) for the specific service in question. Awcuvix shall not be liable for any indirect, incidental, or consequential damages.

8. Indemnification

The Client agrees to indemnify and hold harmless Awcuvix from any claims, damages, or losses arising from the Client’s (or their worker’s) misuse of technology or failure to follow safety protocols provided during training.
